Public Works and Procurement Rules Amended

State and local public works projects are subject to statutory requirements that affect advertising, bidding, preference, sourcing, contracting, and other aspects. (Read more about public works here.) That is, unless an exception applies. One such exception — a dollar threshold below which those statutory requirements do not apply — was increased by the Georgia General Assembly. Once signed by the Governor, H.B. 137 increases the dollar threshold for exemption from $100,000 (local schools, local BOEs, and state procurement), $150,000 (state public works), and $200,000 (counties and municipalities) to $250,000. Thus, for each of these governmental units, the dollar threshold for exemption from the statutory public works and procurement rules will be $250,000.

Some statutory requirements will continue to apply, so public works and procurement projects need to be reviewed by procurement counsel.
